Terms of Service

Last Updated: 3/1/2025Welcome to Upstate Appliance Rentals, LLC! These Terms of Service ("Terms") govern your use of our washer and dryer rental services (the "Service"). By using our Service, you agree to these Terms. Please read them carefully before renting from us.---1. Eligibility & User Requirements
• You must be at least 18 years old to rent our appliances.
• A valid payment method and delivery address are required.
• You agree to provide accurate and up-to-date personal information.
2. Rental Agreement
Monthly Fee: Rates start at $60 per month per set of washer and dryer (Standard), plus tax. Deluxe is $85 per month and is reserved for brand new, stackable, digital, and/or luxury units. Rent is due First month is due on the day of delivery.
One-Time Delivery Fee: $40 per set, charged on the day of delivery, to any address in Greenville or Spartanburg counties in South Carolina. Deliveries outside of this area is subject to review and milage upcharge.
Booking Fee: $1, to gather customer data, save info in system, reserve booking date/time and the rental units. Refunded on collecting the first monthly payment.
Credit Card Processing Fee: $2.50 per swipe, except on the booking fee.
Billing: Payments are billed automatically on a recurring monthly basis. Your due date is the day of the month that you were installed. You may change payment information on the Customer Portal.
3. Payment Terms
Timely Payments: On-time payments are very much appreciated. Please remove any stops or holds on your accounts for our invoices. Charges from us will appear as UPSTATEAPPLIANCERENTAL on your bank statement.
Late Payments: Communication is crucial: if you expect to be late on a payment, please reach out to us before your due date. We are more than willing to work with you — we understand that unexpected situations happen.
If a payment is late, we will make automatic collection attempts for the next 14 days. Our team will contact you on day 1 and day 14 via email, phone, and text message to remind you and arrange payment. If a payment remains unpaid for 14 days after the due date without any communication from you, your service will be suspended.
We do not charge late fees: If your account is uncollectable, we will initiate the process to recover our equipment. Please make arrangement for us to retrieve our property within 48 hours. Failure to do so may result in legal actions.
Our goal is always to resolve payment issues collaboratively. We truly don’t want things to escalate, so please keep the lines of communication open with us.
Subscription Cancellations: Subscriptions may be canceled with at least 7 days' notice before the next billing cycle. No refunds are issued for partial months.
Delivery Cancellations: Deliveries may be cancelled with at least 24 hours' notice before your scheduled delivery time, otherwise a cancellation fee of $100 will be assessed.

3a. Option to Purchase
Option to Purchase/Rent-to-Own: Renter may select the option to purchase at any time. Standard rent-to-own term is 36 on-time installments at the normal rental rate. On-time payments made before adding the Option to Purchase will be credited to the balance of the Option. Shorter installment terms are available at a higher rental rate. A late payment is counted as a missed installment, and the next on-time payment resumes the installment countdown. Once your installment balance is zero, you own the equipment.
Early Payoff/Same as Cash: Renter may elect to pay off the Option to Purchase at any time during their rental period by contacting our Billing team. Amount is determined at the time of election as the balance of installments remaining. Early payoff will be invoiced separately from monthly installments.

4. Installation, Maintenance, and Repairs
• We will install and setup the units at the agreed delivery location.
• Customers must ensure proper installation space and provide necessary utility connections.
• Routine maintenance and repairs due to normal wear are covered by us.
• Customers must report any issues promptly. Damage due to misuse may result in repair fees.
5. Equipment Ownership & Usage Rules
• The washer and dryer remain the property of Upstate Appliance Rentals.
• Customers may not sell, sub-lease, or modify the equipment.
• Units must be used for their intended purpose in residential settings only, and only at the address indicated in your Agreement.
6. Liability & Damages
• Customers are responsible for damages resulting from misuse, negligence, or unauthorized modifications.
• Lost or stolen units will incur a replacement fee equal to the market value of the unit.
• Upstate Appliance Rentals is not liable for indirect damages, such as property damage or loss of income, due to equipment failure.
7. Service Modifications & Termination
• We reserve the right to modify pricing or service terms with 30 days' notice.
• We may terminate a rental agreement for non-payment, misuse, or policy violations.
• Upon termination, customers must arrange to return their equipment, in good condition, or be subject to replacement fees.
8. Privacy Policy
• We collect and store customer information to provide our Service.

9. Dispute Resolution & Governing Law
• Any disputes must first be addressed through direct negotiation.
• If unresolved, disputes will be settled through arbitration in South Carolina, USA.
• These Terms are governed by the laws of South Carolina, USA.
